The service

Creative Listening is a guided reflective and creative program delivered through a series of modules. The program includes journaling, mood tracking, artwork uploads, and reflective prompts. We may update, add, or remove content at any time without notice.

Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this program. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

• ·You may delete your account and associated data at any time from your profile.

Your content

You retain ownership of the journal entries, reflections, and artworks you create and upload within the program (your “Content”). By submitting Content, you grant us a limited licence to host, store, and display it solely for the purpose of providing the program to you.

You are responsible for ensuring that your Content does not infringe the rights of any third party or breach any applicable law.

Acceptable use

You agree not to misuse the program or assist anyone else to do so. In particular, you will not:

• ·Attempt to gain unauthorised access to any part of the program or another user's data.
• ·Upload content that is unlawful, defamatory, infringing, or otherwise objectionable.
• ·Interfere with or disrupt the program's servers, security, or functionality.

Privacy

We handle your personal information and Content in accordance with applicable privacy laws. Your journal entries and artworks are associated with your account and are not shared publicly. Please refer to our privacy practices for details on how your data is used and protected.

Intellectual property

The program's structure, module content, prompts, design, and branding are owned by Creative Listening and protected by intellectual property laws. You may not copy, reproduce, redistribute, or create derivative works from the program materials without permission, except for your own personal, non-commercial use.

Limitation of liability

The program is provided “as is” and “as available.” To the fullest extent permitted by law, we exclude all warranties and conditions, and shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the program.

This does not affect any rights you may have under consumer protection laws that cannot be excluded.

Changes to the service and terms

We may modify or discontinue the program, or update these terms, at any time. When we change these terms, we will update the “Last updated” date above. Continued use after changes take effect constitutes acceptance of the revised terms.

Termination

You may stop using the program and delete your account at any time. We may suspend or terminate your access if you breach these terms or where we believe it is necessary to protect the program or other users.

Governing law

These terms are governed by the laws of the jurisdiction in which the program is operated, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of that jurisdiction.
